Please read these Terms of Service carefully because as hellogive hosts and participants, it is necessary for you to sign up to these terms and conditions, and they also contain important information about the dos and don’ts on the hellogive platform and your legal rights, remedies, and obligations.
By accessing or using services on the hellogive platform, you are agreeing to the terms and conditions of these Terms and entering into a contract with us that governs the use of the Services. Only if you agree to these terms and policies., we can allow use the services of hellogive.co.

Definitions:
Host” means a Program creator using our platform to create programs/events attributed to a social cause.
Participant” means individuals using our platform to attend events/programs.
Material” includes information, data, text, editorial content, design elements, formatting, graphics, images, pictures, photographs, videos, music, sounds, and other content.
“Services” include all the services offered on the hellogive.co platform.
Site Content” refers to Material offered directly via the platform or made available by hellogive in connection with the Services.
Your Content” is any Material that you provide or make available to hellogive.co in order to use the services or that you authorize us to use.
Your Trademarks” are the trademarks, trade names, service marks and logos that you contribute or that you authorize us to use.
Hosts, participants, and third parties accessing or using our Services are all referred to collectively as “Users“, “you“, or “your“.
When these Terms use “hellogive“, “we”, “us”, or “our” that refers to Hellogive ( A brand of Teqzo Retail products Pvt Ltd). and its employees.
If you will be using the Services on behalf of an individual, entity, business, etc., you agree to these Terms on behalf of that entity for which you have been given the authority.

Role of Hellogive:
We are primarily an e-commerce platform that focuses on events management and self-growth, by offering services and products that enable people from around the world to discover and participate in opportunities aimed at addressing the problems and needs of the global community. We believe that by enabling, hosting and participating in programs that are centered around causes that matter to the global community, individuals will find a sense of purpose, which in turn helps in their personal growth.
Hellogive.co makes it possible for hosts and participants to connect through meaningful “giving” experiences. Through our services, hosts can create, promote, post, and manage online or in-person events, sell tickets, and solicit donations that serve a community need or support a cause—ultimately helping to create a positive impact in society. We also make sure the individuals looking forward to contributing/participating in these events are able to book their slots and participate in events/programs related to causes of their interest with ease.

Terms and conditions governing the Host:
As a host, you must register on hellogive as a host after agreeing to comply with the Terms and Services. All information you submit must be truthful, accurate, and complete, and you must promptly notify us of any changes. After registering for the host services, we may require you to provide additional information about yourself, the entity you represent (if any), which may include current address, details of business, description of products, website address, bank account or other payment account information, date of birth, passport or drivers license number, country of origin, copies of government identification documents, and other personal information.
We may use this information to verify your identity, the validity and/or legality of your transactions, and/or whether you qualify to use the host services. We reserve our right to approve or disapprove you from hosting a particular event or events on hellogive platform.
You may not use the host services to host programs or process any of the transactions involving animal abuse, adult content or activities, child endangerment, substance abuse, dangerous groups or individuals, hate speech, illegal goods or services, or any fraudulent or criminal connection.
When hosting an event, the host is solely responsible for ensuring that their event complies with any applicable laws, rules, and regulations of the state and the country and that the goods and services described on the event page are delivered as described in an accurate, satisfactory manner.
As part of the host’s services, we help the host sell tickets, registrations, and other items related to the event to participants interested in their events. To facilitate payments for the hosts, we partner with third-party payment processors. Hosts and hellogive are subject to the rules and regulations of our Payment Processor Partners. If hosting an event with paid tickets, the host selects the payment processing method that can be offered to participants for its event. Participants must use the payment processing method the host selects for payment.
When you use hellogive Payment Processing, we act as your payment agent to facilitate payment transactions on your behalf using our Payment Processor Partners. As a limited agent, we process the total value of tickets, registrations, and other items purchased by participants for your events. In return, in addition to the applicable hellogive Service Management Fees, (to cover the listing and publishing of Your Events on our platform) the host will pay us the Payment Processing fee for each ticket sold or other item sold or donation accepted, for facilitating the transaction.

Payouts: Within five business days after the conclusion of the event, hosts who use hellogive payment processing will receive the payouts after deducting the Service Management Fees, Taxes and any other  Deductions if applicable. At that time, our Payment Processor Partners will facilitate the payout to your preferred payout method. We will not be liable for delayed, rejected, or missed payouts that occur from the delay, failure, or contractual breach by the host, a Payment Processor Partner or any other third-party provider. We and our Payment Processor Partners rely on the information you provide to facilitate payment transactions on your behalf. If any account or card details that you provide to us or our Payment Processor Partners are incorrect, you must reimburse, indemnify, and hold us and our Payment Processor Partners harmless for any losses or expenses incurred by us relying on the incorrect information.
When a participant makes a payment (e.g., when they purchase a ticket for an event) and that payment is then processed by one of our Payment Processor Partners, you will sell or provide the participant all advertised goods and services, regardless of whether you have received the event payouts.
We, acting as your payment processing agent, are authorized to hold, retain and pay out Event Proceeds to you using our Payment Processor Partners, transfer or upgrade a participant’s ticket or registration, if you allow the same in your event registration process, issue refunds to participants as and when applicable.

Refund Policy :
It is your obligation to handle refunds and settle refund disputes if you have not used hellogive payment processing.
Regardless of the payment method selected, all disputes regarding refunds are, in principle, between the hosts and participants. In the event of a dispute, we may try to mediate, but ultimately it is the obligation of the host to settle the dispute. For hellogive payment processing transactions, we still have the right to make Specified Refunds on your behalf and at your expense.
Please make sure that your events are ticketed correctly. We are not responsible for any fake or invalid tickets
You must set a refund policy and communicate it to Consumers for each event.
Hellogive payment processing fees are typically non-refundable, regardless of the cancellation or postponement of your hellogive Events.

If you are a host, you will at all times comply with all applicable local, state, provincial, national, and other laws, rules, and regulations with respect to information you collect from (or receive about) partcipants or other individuals, and comply with any applicable policies posted by us on the Services with respect to information you collect from (or receive about) partcipants.

Pricing :
Free events are not charged any fee.
5.5% service Management fee per paid ticket for paid events.
2.9% payment processing fee per transaction.
Fees are paid by participants when they buy the tickets, unless the host chooses to cover them.

Termination:
We may suspend or terminate your right to use the hellogive Services at any time, including if, you breach these Terms or any other agreement between you and us, or if you fail to pay any due amounts, you misuse or abuse the Services, you engage in any conduct using the hellogive platform in a way that jeopardizes the safety of our community or integrity of hellogive, permitting you to use the hellogive Services would violate any applicable local, state, provincial, national, or other laws, rules and regulations or court order or would expose us to legal liability.
We may choose to stop offering the Services, or any particular portion of the Services, or modify or replace any aspect of the Services, at any time for reasons we may find justified without offering you an explanation. We will use reasonable efforts to provide you with notice of our termination of your access to the Services. You agree that we will not be liable to you or any third party as a result of our termination of your right to use or otherwise access the Services.
You may terminate your access to the Services and the general applicability of Terms by deleting your account, except as agreed otherwise in a separate written agreement between you and us. If you are a participant using the Services without a registered hellogive account, as long as you continue to access the Services, even without an account, these Terms remain in effect. these Terms no longer apply if you stop accessing the Services indefinitely.
These Terms apply to you as soon as you access the Services by any means and will continue to apply until they are terminated by hellogive.
However, the terms related to the use of data retrieved by you using hellogive services will have to comply with all applicable local, state, provincial, national, and other laws, rules, and regulations, even after you stop using our services.
Certain provisions of these Terms that demand survival even after termination, including all limitations on liability, releases, indemnification obligations, disclaimers of warranties, agreements to arbitrate, choices of law and judicial forum, and intellectual property protections and licenses, will continue to be in effect till necessary even after termination of services by any means.

Release & Indemnification :
The hosts or participants won’t bring hellogive into any disputes between themselves and a third party.
You hereby agree to release, defend and indemnify hellogive from any and all damage (whether direct, indirect, incidental, consequential or otherwise)all losses, liabilities, costs, and expenses of every kind and nature, known and unknown, arising out of a dispute between you and a third party (including other Users) in connection with the Services or any event listed on the Services, including Your hellogive events, any failure to obtain or maintain any Licensure, or any error in obtaining or maintaining any Licensure, any Feedback issue, Your Content or Your Trademarks.
You agree to offer indemnification if a third party comes after us because of something you did or failed to do.
You also agree to defend, indemnify, and hold harmless the hellogive team from loss, liability, cost and expense (including reasonable attorneys’ and accounting fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator or otherwise) or investigation made by any third party relating to events conducted using our services.

Disclaimers :
Hellogive disclaims all warranties of any kind, including implied warranties of services and merchantability offered by third parties on the hellogive platform. We make no warranty that the Services (or any portion of the Services) will meet your requirements or expectations or will be uninterrupted, secure, timely or error-free.
We have no control over and do not guarantee the (i) quality, safety, success, accuracy, or legality of any event or Site Content associated with an event, (ii) accuracy of any information provided by Users (including Feedback and participants’ personal information shared with hosts in connection with events), or (iii) ability of any User to complete a transaction.
Some events may have some risk involved, and by participating in those events, you choose to accept those risks voluntarily. Few events may carry the risk of overcrowding, illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those events.
Most events on our platform are not hosted by hellogive, but if and when you participate in one that is, you assume all risks. When you attend an event hosted by us, you waive any and all claims and causes of action against the event producers and presenters, and their insurers, for liability, including for personal injury, property damage or wrongful death in connection with your attendance at the event.
When you enroll, make a payment or participate in an event hosted by a third party using their hyperlink provided on the hellogive platform, you waive any and all claims and causes of action against, the hellogive team for any liability, including event not happening in the way mentioned by the host, for personal injury, property damage or wrongful death in connection with your attendance of the event.
The disclaimers will apply so long as they are allowed under the law.
In addition to our obligation to pay out Event Proceeds, in certain circumstances,
for hosts of events on our Site with paid tickets, the hellogive’s maximum aggregate liability is limited to the hellogive Fees (net of any hellogive Payment Processing Fees) that the host paid us in the two months immediately preceding their request for claim.
For other Users, the total price of all tickets or registrations, minus the hellogive service management fee, that the User purchased or made through the Services in the two (2) month period immediately preceding their claim.

Customer Support :
You agree to contact our customer support team and register your grievance prior to initiating any legal proceeding.
Our customer support team will try its best to resolve your concern.

Arbitration Process :
In the unlikely event that our customer support team is unable to resolve your concerns, you and we each agree to resolve all disputes and claims between you and us, including any arising under or relating to these Terms, your use of the Services, through binding arbitration. All arbitrations and small claims proceedings will proceed only on an individual basis.

License to the hellogive services :
Your right to use our Services is limited to browsing the Services and searching for, viewing, registering for, or purchasing tickets or registrations to an event listed on the Services; and/or creating event registration, host profile and other webpages to promote, market, manage, track, and collect sales proceeds for an event.
Your use of the Services and site content must comply with these Terms and all applicable local, state, provincial, national and other laws, rules and regulations. In addition, by using any search functionality or address auto-population tools, you are bound by the Google Maps/Google Earth Additional Terms of Service (including the Google Privacy Policy).
You agree that all Site Content may be protected by copyrights, trademarks, service marks, trade secrets or other intellectual property and other proprietary rights and laws. You can’t copy, sell, or use our Services in a way that is damaging to hellogive.

Licenses and approvals for hosts:
The host will obtain, before starting ticket sales, all applicable licenses, approvals and authorizations for your hellogive events, which include national, state, municipal, or other local authorities’ authorization of the event, including traffic, health, pollution, police departments, etc., as and when applicable.
You will comply, and will ensure that the venues for your hellogive events will comply with all applicable laws, regulations, rules, and ordinances.
In case of any unexpected event relating to cancellation of your program, you will inform the participants about the cancellation and do all that’s necessary to prevent physical and emotional and financial damages that might occur due to the cancellation of the event.
You will provide evidence of Licensure and related information prior to offering tickets or registrations for your Hellogive events and promptly upon our reasonable request from time to time.

Fees and Refunds :
Fees: We do not charge anything for creating an account with Hellogive. We also do not charge any service fee on tickets if they are free events. However, we charge fees when it’s a paid event,to buy/sell paid tickets. These fees may vary based on individual agreements between us and certain hosts. Hosts may determine whether these fees will be passed along to participants and shown as “Service management Fees” on the applicable event page or absorbed into the ticket or registration price and paid by the host to us out of ticket and registration gross proceeds.
Refund Requests :
Refunds to participants apply to paid events hosted on Hellogive in which the participants have booked tickets on the Hellogive platform directly and not through affiliate websites.
For the above-mentioned events, if the participants would like to cancel their participation, then they can claim a refund from Hellogive, provided:
a) They cancel the tickets on HelloGive website
b) after cancellation of the ticket, they should request a refund anytime before the event commences or is supposed to have commenced or within 3 days after the event has concluded
c)The refund will be processed within 15 days of receipt of the claim.
For events where the tickets have been booked on third-party affiliate websites, the refund will have to be claimed from the third-party hosts, and Hellogive will not be able to process the refund at any point, as in this case, the financial transaction is directly between the participant and the third party.
Participants requesting a refund should contact the host. Participants must not use a ticket that has been cancelled/refunded, and hosts must not accept invalid tickets.
We will not be liable under any circumstances for any costs arising from hosts’ non-compliance with the procedures that must be implemented by hosts to check the validity of tickets. We will not be liable under any circumstances for costs and/or damage arising from ticket-related fraud and/or the purchase of the ticket through non-official means, such as third parties.

Do’s and Don’ts :
When you create an account with us or use our Services, you must provide us with accurate information and agree in letter and spirit that your Services are not targeted at exploiting or creating damage (physical, financial, or emotional) to any section of society, including children.
If you are using the Services on behalf of a company or other entity, you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms.
You will immediately notify us of any unauthorized use of your password or account, or any other breach of security.
You are responsible for any activities that occur under your account.
You will not use the Services to collect any sensitive personal information from users, such as health information, financial information, payment card numbers, driver’s license numbers, and passport numbers, unless we have otherwise consented to the collection of the information in writing.
Your content must be accurate and truthful. We reserve the right to remove Your Content from the Services if we believe that your content or your hellogive events violate these Terms or for any other reason.

HelloGive’s use of your content and your trademarks :
You hereby grant us a license to access, use, reproduce, modify, display, translate, publish works based on your content, in whole or in part, for the purpose of operating the services, promotional and marketing services, which may include promotion of you and your hellogive events on a third-party website or other social media and for hellogive’s internal purposes.
We don’t claim ownership of your content or your trademarks, but these licenses are essential to provide you with the Services and help your Hellogive events.
We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Services, as well as feedback, comments, suggestions, and ratings regarding the services and events of third parties, such as the hosts of events you attend. Any Feedback you submit to us will be considered non-confidential and non-proprietary to you. By submitting Feedback to us, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, publish, and exploit those ideas and materials for any purpose, with or without your name, without compensation to you. We may collect testimonials, ratings, and reviews about Site Content, the Services, and, if you are a host, Your Content and events, and we may use them for legitimate purposes.
The Services or Users may provide links to other Internet websites or resources. Because we have no control over such websites and resources, you agree that we are not responsible for the availability of such websites or resources. We do not endorse and are not responsible or liable for any Site Content, advertising, offers, products, services, or other materials on or available from such websites or resources and are not responsible for any damages or losses related to them, even if such websites or resources are connected with our partners or third-party service providers.

Data Privacy Policy :
We collect personal data when you voluntarily provide such information to the services, such as when you contact us with inquiries, register for or purchase tickets to an event, or browse or use certain parts of the services. The personal data we may collect includes, without limitation, your name, address, and email address.
Certain technical data is automatically sent to us from the computer, mobile device and/or browser through which you access the services. This may include information about your browsing behaviour, page visits, clicks and cursor movements and searches on our sites. The information (including your IP address) collected by these technologies may be disclosed when needed for legal issues or when any other reason as and when requested by the concerned authority.
If you are a host, we will collect additional Personal Data from you, like your credit card information (e.g., your credit card number and expiration date, billing address, etc.), some of which may constitute Personal Data, to secure certain payments. In addition, if you use our payment processing services, we will collect financial information from you (e.g., your bank account information or an address ) as necessary to facilitate payments and information required for tax purposes. When you create an event, we may ask you to provide a phone number and send you a text message to verify your account and prevent fraudulent activity on our Services.
If you are a participant, we will collect additional Personal Data from you, sometimes for our own purposes and other times on behalf of a host.
If you register for a paid event, you will provide financial information (e.g., your credit card number and expiration date, billing address, etc.), some of which may constitute Personal Data. In addition, hosts can set up event registration pages to collect virtually any information from participants in connection with registration for a host’s event listed on the Services. Hellogive does not control a host’s registration process nor the Personal Data that they collect. When you register for, or otherwise provide information to Hellogive in conjunction with a host event or activity, whether that information is yours or a third party’s, in connection with a purchase, registration, or transfer, that host will receive and may use the information you provide.
If you engage with the Hellogive sales team and consent to recording a meeting, the sales team may collect audio and/or video recordings of you.

Use of the above data:
If you provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided.
If you provide Personal Data in order to obtain access to or use of the Services, we will use your Personal Data to provide you with access to or use of the Services or functionality and to analyse your use of such Services or functionality.
We may use your Personal Data for internal business purposes, including, without limitation, to help us improve the content and functionality of the Services, to better understand our Users, to improve the Services, to protect against, identify or address wrongdoing, to enforce our Terms of Service, to manage your account and provide you with customer service.
We may use your Personal Data for our marketing and advertising purposes via email, SMS marketing, social media and other avenues.
We allow hosts to use our email tools to contact participants for their current and past events, so you may receive emails from our system that originate with such hosts and that we send on their behalf. If you registered for an event on the Services, your email address is available to that host. However, hosts may also import the email addresses they have from external sources and send communications through the Services to those email addresses, and we will deliver those communications to those email addresses on the host’s behalf. The host and not hellogive is responsible for sending these emails.
If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time the Personal Data is collected or we will obtain your consent subsequent to such collection but prior to such use.
We will not sell your Personal Data to other businesses purely for financial gain. We consider this information to be a vital part of our relationship with you. Therefore, we will not sell your Personal Data to third parties, including third-party advertisers.
We may share your Personal Data with our contractors and service providers who process Personal Data on behalf of hellogive to perform certain business-related functions. These companies include our marketing agencies, online advertising providers, email service providers, payment processing partners, customer support, tech support, hosting companies and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.
We are not responsible with respect to your personal data, for the actions of hosts on hellogive or their third-party hosts or other recipients of your Personal Data via third-party hosts. It is important that you review the applicable policies of the hosts, and if applicable and available, their appointed Third Party hosts, of an event (and the related fundraising page, if applicable) before providing Personal Data or other information in connection with that event or related fundraising page.
When you purchase tickets to, register for or donate to an event, transfer an event ticket or for any other reason specified by the host in connection with the event, that host will receive the information you provide, including your Personal Data. Other third parties that are involved in or on whose behalf an event or activity is promoted may receive that Personal Data as well. You have to do the necessary checks before sharing this data so as to protect them from misuse, and hellogive will not be regarded in any way as responsible for any unintended use or intended misuse of your personal data by any party.
Hellogive’s own website may contain links to Meta and other social media websites as well, such as through the Meta social plug-ins. When you interact with these social media links, your browser will establish a direct link with their servers, and the servers will receive information about your browser and activity. This is for your own information.
We may retain your Personal Data as long as you are registered to use the Services. We may retain your data for a period even if you delete your hellogive account and stop using our services, as may be necessary to meet business and legal requirements.
We do not knowingly collect Personal Data from children under the age of twelve. If you are under the age of twelve,please do not submit any Personal Data on your own, through the Services. We encourage parents and legal guardians to provide the necessary information for registering for an event, if they would like their children to participate in an event and to monitor their children’s Internet usage and to help enforce our Data Privacy Policy. If you think that a child under the age of 12 has provided Personal Data to us through the Services and you want the data to be deleted, please contact the hellogive team, and we will endeavor to delete that information from our databases.
This Data Privacy Policy applies only to hellogive Services. The Services may contain links to other websites not operated or controlled by us (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.
Hosts may use our email tools to send electronic communications to those on their email subscription lists, including participants who have registered for their events on the Services in the past. Although these electronic communications are sent through our system, hellogive does not determine the content or the recipients of these electronic communications. hosts are required to use our email tools only in accordance with all applicable national laws.

These Terms make up our entire agreement with you unless we also enter into a separate written agreement.
We reserve the right to modify these Terms as and when needed to suit certain business requirements. We will send a formal communication as and when modifications are made, if we believe that the modifications are relevant to the registered users of hellogive.

Except as otherwise stated in these terms, these terms are the entire agreement between you and us and govern your use of the Services, superceding any prior agreements or communications between you and hellogive on the subject matter of these Terms.
If we fail to enforce any part of these Terms, that will not amount to a waiver of our right to later enforce that or any other part of these Terms.
